Terms of Service for Aidme.ch

1. Agreement to Terms
By accessing or using our website www.aidme.ch (the "Website"), and any associated applications or products offered by Aidme.ch (collectively, the "Services," including but not limited to the "RFP Proposal Generator" tool accessible via rfp.aidme.ch), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Services.
2. Service Description
Aidme.ch provides and/or facilitates access to various AI-powered tools and informational content designed to assist users in simplifying complex tasks. Our services, such as the RFP Proposal Generator, leverage technologies including Streamlit for frontend delivery, Replit for hosting aspects of certain applications, and the OpenAI API for language model functionality. The specific features and functionalities may vary per service.
3. User Accounts and Responsibilities
To access certain Services (like the RFP Proposal Generator), you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account password and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You agree not to misuse the Services and to use them only in compliance with all applicable laws and regulations. You are responsible for the accuracy, legality, and appropriateness of the content you provide to or generate using the Services.
4. Purchases and Payments
Access to certain features or extended use of our Services may require payment. For example, our RFP Proposal Generator service operates on a credit-based system where users purchase "offer credits."
By making a purchase, you agree to our pricing and billing terms as specified at the point of purchase (e.g., on the `purchase_offers.php` page for the RFP tool). All payments are processed through our third-party payment processor, Stripe. We do not store your full credit card details.
For offer credits specifically related to the RFP Proposal Generator: credits purchased do not have an expiration date and may be used as long as the service is available. Unless otherwise stated, once credits are purchased, they are non-refundable. Specific refund policies, if any, will be detailed at the point of purchase or for specific offers.
5. Intellectual Property
The Services and their original content (excluding content provided by users or generated by users for their own purposes), features, and functionality are and will remain the exclusive property of Aidme.ch and its licensors. This includes, for example, our proprietary prompt engineering and solutions architecture for tools like the RFP Proposal Generator.
Content generated by you using our tools (e.g., proposal documents) is your property, and you may use it freely. However, the underlying technology, templates, and methods used to generate that content remain the intellectual property of Aidme.ch.
6. Limitation of Liability
Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide accurate, reliable, and helpful outputs (e.g., from the RFP Proposal Generator), Aidme.ch makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Aidme.ch shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage. You acknowledge that you use the outputs of our AI tools (like generated proposals) at your own risk and are responsible for their final review and use.
7. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us.
8. Modifications to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
